Earl Blumenauer's office from noon to 2 for nearly 65 Thursdays. The photo below the line shows part of our 15-person picketing crew. I'm the one with the "Blumenauer/Traitor to the Oath" sign and the usual impeach T-shirt that we all wear to drive him and his aides crazy.

Deluge of impeachment Petitions to be filed in Congress?

Congressman Dennis Kucinich’s resolution to impeach Vice President Dick Cheney now has more cosponsors signed onto it than any resolution to impeach President Richard Nixon ever had. But separate resolutions to impeach Nixon, some with a handful of cosponsors, many with no cosponsors at all, were filed by the dozens. Today, Kucinich’s resolution stands alone.

“Back in 1973,” Barbara Ellis wrote in a recent paper that has inspired a new strategy among advocates of impeachment, “nearly 90 Democratic House members banded together to hopper separate bills to impeach Nixon. Two-thirds of them were to investigate whether Nixon’s deeds rose to the level of Constitutional standards for impeachment; the other third were plain-vanilla articles of impeachment. In October alone, a flood of 40 bills were filed in that Democratic-controlled House.”

Today there are 50 or 60 members of Congress who openly or secretly support impeachment or impeachment hearings for Cheney. There are 26 who have signed onto actual articles of impeachment (Kucinich’s resolution), several others who have signed onto a letter to Judiciary Committee Chairman John Conyers urging impeachment hearings, several others who have made public comments suggesting they favor the hearings, and several more who signed on during the last Congress to Conyers’ resolution to create a “preliminary impeachment investigation.” Conyers has not reintroduced that bill.

A group of citizen activists from around the country has been meeting with members of Congress and their staffers to argue a case for recreating what they are calling the Nixon flooding plan. If, they argue, just the 30 or 40 members who are currently pushing for Cheney’s impeachment were to file their own resolutions, the impact would be far greater than simply adding more names to Kucinich’s bill or to a Dear Colleague letter. All that is needed, in other words, to move impeachment forward in the House might be for those who already claim to support it to put their printers where their mouths are and crank out a couple of dozen new bills.

In the Nixonian example, many of the bills introduced were very short and simple, and many were nearly identical to each other. Others picked out a few favorites from the list of available abuses by that president. In the case of Dick Cheney (or George Bush, for that matter), Congress Members could turn to the recent example of Congressman Jay Inslee’s short and simple resolution to open an impeachment hearing on Attorney General Alberto Gonzales. (Thirty-two members got behind that bill, and surely more would have signed on had Gonzales not resigned. Now, Gonzales’ replacement is repeating his crimes and abuses of power, but impeaching Mukasey would just highlight the fact that Bush and Cheney are giving the orders and that the Senate approved a clone of Gonzales as his replacement.) Beyond Gonzales-style resolutions that simply create hearings, pro-Constitution congress members could pick from a select menu of those abuses in which (unlike most of the Bush-Cheney abuses) Congress has not been complicit. These include rewriting laws with signing statements and proceeding to violate numerous statutes, refusals to turn over information, misleading Congress, refusals to comply with subpoenas, ordering former staffers not to comply with subpoenas, refusals to enforce contempt citations, commuting the sentence of a former top staffer who obstructed an investigation that involved Cheney and Bush, exposure of an undercover agent as punishment for a whistleblower, running a secret energy task force in violation of open-government laws, profiting through no-bid contracts to a war profiteer, election fraud, and the criminally negligent response to Hurricane Katrina.

Barbara Ellis, the author of the paper excerpted above, is an impeachment activist in Oregon and a member of a group called the National Coalition of We the People. Three members of this group, Michael Greenman from Ohio, Marcia Meyers from Oregon, and Carl McCargo from Massachusetts, traveled to Washington, D.C., last week and met with 32 congressional offices, in some cases with members and in others with staff. They intentionally included among those they spoke with some of the leaders of the original Nixon Flooding Plan who are still in Congress: Pete Stark (CA-8), John Conyers (MI-1), William Lacy Clay (MO-1), David Obey (WI-7), and Charles Rangel (NY-19).

The group reported on their congressional visits: “The Nixon Flooding Plan was met with high interest from all of our 32 Congressional contacts as a practical strategy for helping them to live up to that oath of office. Using our networking knowledge of and confidence in the millions of Americans passionate about impeachment, we promised those who take up the Nixon plan national recognition and support and offered sample investigation/impeachment bills for their convenience in drafting such a bill. One constant heard from House members and/or their key staffers was their message: ‘We need to hear from our constituents’ about trying that multiple-bill approach.

“So the main effort we’re launching is a drive in the national impeachment movement for a “National Call for Impeachment Bills.” We’ll focus on the week of March 16 – 22 to flood House members with our support for either bills on investigations for impeachment or articles of impeachment.

“One message House members need to hear is that participants in that Nixon plan were re-elected in 1974 (five are still in the House). Only two participants were not re-elected, but not because of hoppering an impeachment bill against Nixon. Republican Paul McCloskey lost to a Democrat; and Bill Roy ran for Senate. Not only did the Democrats control the House in 1973-75 (242-192-1)), but they added nearly 50 more members (291-144) three months after Nixon resigned.”

Congressman Kucinich has drafted over 50 articles of impeachment against Bush, and he should be encouraged to introduce those soon. But he and every member of Congress should be encouraged to introduce their own favorite resolution with regard to Cheney, even if it’s simply a proposal to hold impeachment hearings.

The week of March 16-22 is a week when Congress Members are home in the districts. It’s also the five-year point in the occupation of Iraq. A number of impeachment groups led by Code Pink have already designated the 18th a day for impeachment events. Why not plan now to pay a visit to your congress member’s local office that week? Rep. DeFazio (D-OR) endorses Wexler letter for Cheney impeachment investigation

WASHINGTON – Rep. Pete DeFazio, D-Ore., officially joined a small but persistent group of Democrats Wednesday calling for a robust investigation into the tenure of Vice President Dick Cheney as a possible prelude to impeachment.

DeFazio agreed to sign a letter circulated by Rep. Bob Wexler of Florida who has been relentlessly driving the so-far unsuccessful effort to boot Cheney from office.

Wexler is backing his demands by orchestrating a petition drive aimed at showing public demand for investigating Cheney. The focal point of that effort is a website that allows anyone to sign the impeachment petition. So far he has 227,000 signatures.

“The charges against the vice president relate to the core actions of this Administration, its unlawful behavior and its abuse of power,” Wexler wrote in a letter to House Judiciary Committee Chairman John Conyers.

“As you know, the charges against Vice President Cheney include providing Congress and the American people false intelligence leading up to the Iraq war, the revelation of the identity of a covert agent for political retaliation, and the illegal wiretapping of American citizens,” says the letter, which was signed by Wexler, DeFazio and 13 other lawmakers.

DeFazio, who has been a frequent critic of the administration, said he had remained largely on the sidelines of the impeachment debate until now because it was centered in the Judiciary Committee of which he is not a member.

But Wexler circulated the current letter more broadly, allowing members like DeFazio and opportunity to official voice their concerns.

Even so, DeFazio isn’t quiet as absolute as Wexler, who has been calling for impeachment for months.

DeFazio said in an interview that he supports aggressive oversight hearings into questions surrounding Cheney’s performance but is withholding calls for impeachment until a case is made. “I have said I want to have the most aggressive oversight … regarding malfeasance by this administration,” DeFazio said.

“Cheney is the pivot point to the most nefarious practices of this administration.”

Despite Wexler’s persistence and DeFazio’s seniority, it is unlikely that House Speaker Nancy Pelosi will allow impeachment activities. She has said repeatedly and consistently that impeachment “is off the table” because it would get in the way of other priorities facing Congress.

Oregon: City Impeaches Bush/Cheney

On Tuesday, February 5, 2008 the City Council, City of Cannon Beach, Oregon, voted 3 to 2 in favor of sending a resolution to congress… to undertake impeachment proceedings on President George W. Bush and Vice-President Richard Cheney. The vote followed a public hearing which was requested by a petition signed by 227 persons. This petition was initiated as a fulfillment of last wishes for a life long resident and mentor to many – Gainor Minott.

Arguments Against Bush Impeachment...

• If we impeach Bush, we’ll get President Cheney!
The first impeachment resolution introduced by McKinney included Bush, Cheney, and Rice. Although, even if we only initially pursue Bush, initiating the impeachment process will lead to an investigation that will implicate lots of people in the Bush administration who are guilty of committing crimes, including Cheney.

No matter who we get to replace Bush, we’ll be showing those in power that anyone who breaks the law will be held accountable.

• Promoting impeachment will seem too “extreme.”
Demanding that crimes be investigated is NOT extreme. Some previous impeachment attempts were considered extreme because they were pursued for actions that didn't rise to the level of a Constitutional crisis, which is what the impeachment tool is meant to be used for. Nixon's impeachment, however, was bipartisan.

  • We should wait to impeach...
Wait to impeach? We've waited 3 or more years too long already. We had enough evidence to impeach years ago. Remember, an impeachment only means you have enough evidence to warrant a trial, just like an indictment. Our congress people didn't take an oath to bipartisanship. They took an oath to the Constitution. Besides which, our troops, Iraqi civilians, and our own civil liberties are all waiting for this.
 
• Before we impeach, we should get some legislation passed...
And with unconstitutional Presidential Signing Statements, veto power, and the power of "Commander in Chief" at his disposal, how do you think Congress is going to get anything accomplished without first impeaching Bush?

If your tire blows while you're driving, do you stop to fix it? Or do you continue driving on your rim because to stop would take too much time?

• It hurts the democracy to go through a presidential impeachment. And Bush is a lame duck anyway.
Holding government officials accountable for their actions strengthens our democracy. Letting lawlessness stand weakens it.

Sometimes reprimanding a child (president) doesn't make the family (Washington) a happy place. But you still have to do it so the child and his siblings (future presidents) learn about accountability. Impeachment is horribly UNDERUSED, which is part of why there's so much corruption at the top. Politicians must learn to fear it. People think things are better because we improved the make-up of our law-making body, Congress. But Bush is BREAKING LAWS. So, it doesn't matter how many laws Congress passes if they don't serve their OVERSIGHT duties as well by impeaching. They swore to defend the Constitution. What are laws without enforcement?

Besides, considering Bush's track-record of breaking laws, he can still do a lot of damage. Our troops, Iran, and our Supreme Court are all endangered so long as he remains in office. Waiting until Bush is out of office will leave us complicit in any further crimes he commits. The Union of Concerned Scientists has estimated that the death toll from a "tactical" nuclear weapon of the kind Bush is contemplating using in Iran would be at minimum 3 million men, women, and children. The path of death would stretch across country boundaries into India.

Perhaps worst of all, we set a terrible precedent by allowing Bush to stay in office after he's broken so many laws. Impeachment will stop future presidents from using Bush's actions as justification for even more lawbreaking and erosion of civil liberties.

• I'm a Democrat/
Republican. If we support impeachment it will lower the chances of my party winning in 2008.

So, your party would rather win elections than do what's right for the country? I hope you're wrong. I also hope the public is willing to throw additional support to any party that holds our elected officials accountable for their actions. This has been historically true with every single impeachment effort launched. And this impeachment effort would begin with majority support (unlike most past impeachments including Nixon).

• Impeachment will never happen. Congress members will block it.
Well, all we need is a majority of support in the House. And 2/3rds vote in the Senate to remove Bush from office will happen once the evidence gets aired on the floor of the House, and subsequently the national media outlets. The political pressure will become too great.

Today's impossibility is tomorrow's reality. Congress members will realize that tying their political future to Bush reduces their chances of getting elected. Remember, one way or another, Bush is gone by 2009— but members of Congress may retain their offices beyond that date. Bush's poll numbers are extremely low, and most Americans support impeachment. This is a bipartisan movement. This means that if we make the pressure unbearable for Members of Congress, they'll turn on him to keep their own seats (like they did with Nixon). It's already starting to happen. While many Members of Congress have behaved unethically in the last few years, it's important to understand that this is related to their warped view of what's in their self-interest. Let's wake them up to their true self-interest (impeaching the president), by showing them our support for impeachment.

And even if we only impeach, and the Senate fails to do their duty and remove him from office, it will only implicate the Senators who fail to do their sworn Constitutional duty.

• But Speaker of the House Pelosi said that Impeachment was "off the table."

Pelosi most likely said this to remove any appearance of conflict-of-interest that would arise if she were thrust into the presidency as a result of the coming impeachment. What we need to do is to pressure Pelosi not to interfere with impeachment maneuverings within her party. Sending her Do-It-Yourself impeachments legitimizes her when she joins the impeachment movement in the future.
