Articles of Impeachment To Be Filed On Vice President Dick Cheney

Washington Post — Looks like he’s reached his boiling point.

Rep. Dennis Kucinich (D-Ohio), the most liberal of the Democratic presidential candidates in the primary field, declared in a letter sent to his Democratic House colleagues this morning that he plans to file articles of impeachment against Vice President Dick Cheney.

Kucinich has made ending the war in Iraq the central theme of his campaign. He has even taken aim at the leading Democratic presidential candidates in the field for their votes on authorizing the war.

Article II, Section 4 of the Constitution gives Congress the authority to impeach the president, vice president and “all civil Officers of the United States” for “treason, bribery, or other high Crimes and Misdemeanors.” (More)

Kucinich ALSO says he’s pursuing impeachment of Bush! Well let’s help him out. Sacks and sacks of mail are about to arrive in Dennis Kucinich’s office initiating impeachment via the House of Representative’s own rules. This legal document is as binding as if a State or if the House itself passed the impeachment resolution (H.R. 635).

Kucinich says he is building his case for impeachment, and is working to build the support of his peers in Congress. He says he intends to impeach. He said he needs us to keep building the groundswell of support for impeachment all over the country. He asks that we send him copies of all the resolutions passed in various States, local Legislative Districts, County Districts and of any petitions with signatures, so that he can present them to the floor of the House. He said he felt that our framing the issue of impeachment in terms of the Constitution is a principled choice, and ultimately more effective than just acting on anger. Let’s answer Kucinich’s call with a petition that has it’s precedent in history, and it’s legitimacy in the Rules of the House of Representatives.

There’s a little known and rarely used clause of the “Jefferson Manual” in the rules for the House of Representatives which sets forth the various ways in which a president can be impeached. Only the House Judiciary Committee puts together the Articles of Impeachment, but before that happens, someone has to initiate the process.

That’s where we come in. In addition to a House Resolution (635), or the State-by-State method, one of the ways to get impeachment going is for individual citizens like you and me to submit a memorial. ImpeachforPeace.org has created a new memorial based on one which was successful in impeaching a federal official in the past. You can find it on their website as a PDF.

You can initiate the impeachment process and simultaneously help Kucinich to follow through with the process. Do-It-Yourself by downloading the memorial, filling in the relevant information (your name, state, etc.), and sending it in. We’re not only having you send them to Dennis now, but also to Impeach for Peace. That way, we can collect them all in one place, and deliver them all simultaneously (with cameras rolling) in July.   6. I think it’s critical that the American people take back their country from the usurpers. This country was not created to be an empire nor to shove our democracy down the throats of other countries. Freedom of choice and human rights are what we have been striving to maintain and this administration has trampeled over them far too long. I sincerely hope Kucinich can get our representatives behind him and SOON. We don’t need to have this administration create more opportunities for the rest of the world to hate us even more.

  15. It is apparent to me that the plethora of crimes that Bush and his junta have his junta have commited over their obscene tenure in the white house is not apparently sufficient cause for the equally complicit members of congres to start impeachments proceedings against them.

    May I suggest that someone get a lovely young woman to give Bush oral sex and having had oral sex performed on him, then and only then will congress consider the crime to be so igregious that they will impeach him.

    Things such as, war for lies, destroying the constitution and other high crimes are of no consequence…. but a blow job is definitely it!

    still playing “games” with this issue. What seems to be the
    delay in order for him to start the articles of ompeachment
    against Bush and Cheney? Is he perhaps waiting for Bush to
    attack Iran under false pretences and cause more massive loss
    of life? Is he perhaps waiting for the total loss of the
    people’s freedoms? What exactly is he waiting for?

    It appears to me that he is attempting to milk this approach
    of his for all its worth, in aid of his run for the presidency.

    Although all of us who are informed of the issues know that the case for impeachment of Bush and Cheney has already been clearly made and laid out in multiple books, articles, entire web sites (such as http://www.ImpeachforPeace.org/evidence), the only thing that matters in Congress is what gets spoken into the Congressional Record.

    Kucinich says he is “building a case”. What he is really doing is attempting to build a consensus, or at least a simple majority in the House in order to have impeachment go forward if/when he actually does put it on the floor for debate. The more politicians onboard at the time that articles of impeachent are introduced, the easier to gain more along the way as the facts are spoken into the Congressional Record. Politicians need to be able to point to those emerging facts, then point to constituents that clearly favor impeachment in their own states and districts before hopping onboard.

    That is where ultimately, if impeachment fails, it will be our responsibility. We can’t blame our congressmen and congresswomen.

    Articles of Impeachment against Bush were introduced at the end of tehe 109th Congress by Cynthia McKinney (You go girl!!!), but in many ways it was a mistake in that it was swiftly pushed aside and it was made to look like she was the only Congressperson in D.C. who thought Bush deserved impeachment – which is far from the truth. There are many, they are just afraid to go public because of the threat of ridicule, loss of party support and loss of their cushy seat of power eventually.

    Many believe Bush and Cheney deserve impeachment, but they aren’t going to stick their political necks out unless and until there is enough consensus from their colleagues and from their constituency.

    What bigger issue faces America today than the fact that domestic enemies to the Constitution of the United States of America stole the White House, stole the right to continue to occupy it, and then have systematically conspired to destroy the U.S. Constitution and to use all of America’s finest resources in a power and money grab in the Middle East, lying to Congress, spying on Americans, detaining and torturing Americans along the way as well as countless foreigners?

    What could possibly be more important than defending our nation from these heinous criminals?

    Dear Does Anybody Care?,
    My name is Talia Ray, and I am writing to provide a vital part to a case that the court has undertaken involving my parents’ divorce/custody of my sister, Ava Ray, and me. Firstly, it is critical to the reader’s understanding that they are familiar with the more than likely connections Bernard Kerik (former Police Commissioner and Homeland Security nominee) has with this case. The only reason that I am aware of Mr. Kerik as the primary source of the shamelessly blatant corruption in my “complicated” or “special” case, as many DYFS workers and other Somerset County officials whom I have encountered like to call it, is the simple fact that my mother told me of Bernie’s involvement. Threatened me with it, I should say. My mother, Teresa Ray, told me in an argument we had some time around my freshman year of high school (2003 – 2004) that the judge would not allow me to live with my father, Larry Ray, in spite of my age (I was fifteen years old at the time, which gives my desire concerning the issue of with whom I would reside a little more weight.). When I questioned her apparent certainty that I would not end up living with my dad, she retorted in an overly confident tone that the judge was going to do whatever she wanted the judge to do. This outrageous claim was followed with another bizarre statement by my mother that “Bernie is helping her.” Due to the fact that my father does not involve mie in his personal business affairs (and nothing of his business affairs had yet appeared as a public topic of speculation in the media), I was unaware of the implications that statement had. My mother’s seemingly silly threats to have gained the ability to manipulate the Court into straying from truth and justice did not phase me much; I had confidence in our country’s judicial system. My father’s great respect for this country and the government we live under had always made me feel like I was in good hands here in the United States. I have learned that the beauty of the United States Government is that we all are in fact in each other’s hands, and whether those are good hand sto be in is a matter of how willing we are to protect our fellow American citizens and to continually remind one another of the fundamental liberties guaranteed to us by the U.S. Constitution. I am writing this letter in an effort of self-advocacy; I hope that you, reader, will help me advocate for myself. It is my well-being and my six year old sister’s well-being that have been put on the line here.
    My general complaint is simply this: My constitutional rights, as well as my father’s and my sister’s, have been infringed upon by the Somerset County Court. Consequently, my sister, Ava, and I have been caused severe emotional pain and the inexcusably drastic upheaval of our lives. My father spend six months in federal prison for failing to respond to a court order mandating the transfer custody of my sister and me to DYFS – a court order neither he nor his lawyer was ever served; I was forced to spend ten months isolated in a homeless shelter, and my sister was placed in the custody of our mother who sexually abused us both. We were all robbed any opportunity to maintain our close relationships with one another. Why?
    More specific to this particular letter, I intend to address the fact that Somerset County Court cut me off from any contact with my father. This intrusion by the state upon the personal familial relationship between my father and me was abrupt, unfounded and unconstitutional. I would like to remind the Court of that which Justice O’Conner stated in Troxel v. Granville 527 U.S. 1069 (1999) speaking for the Court,
    The Fourteenth Amendment provides that no State shall ‘deprive any person of life, liberty, or property, without due process of the law.’ We have long recognized that the Amendment’s Due Process Clause, like its Fifth Amendment counterpart, ‘gaurantees more than fair process.’ The Clause includes a substantive component that ‘provides heightened protection against governmental interference with certain fundamental rights and liberty interest’ and ‘the liberty interest of parents in the care, custody, and control of their children – is perhaps the oldest of the fundamental liberty interests recognized by this Court.
    Smith v. City of Fontana, 818 f. 2d 1411 (9th Cir. 1985) recognizes that “the constitutional interest in familial companionship and society logically extends to protect children from unwarranted state interference with their relationships with their parents.” Therefore, it would only make sense for any U.S. Court on the state or federal level to have issued a court order removing me from my father’s custody after a strictly scrutinized interest was substantiated by indisputable evidence proving abuse or neglect by my father. This interest of the court should have been made apparent via record of fair trial out of respect for Due Process Rights before any restrictions were placed on my relationship with my father.
    However, this is not at all what took place. The only explanation DYFS has been able to give me as to why my relationship with my father has suddenly become something I am not allowed to have is that the judge was concerned he might “brainwash” me. The thoughts and feelings I express are the same as those I expressed while living with my father. After being isolated from my father for an entire year plus, not once have I said a singly thing contradictory to what I’ve been saying all along – my mother is a disturbed woman, and while I am finally ready to come to grips with the sexual abuse I suffered by certain members of my family on the maternal side (including my mother), I simply do not feel that attempting a relationship with my mother would be at all appropriate for me. All I want to do is to be living with my father again and for my sister’s complaints of sexual abuse to be paid attention.
    It’s obscene that my sister’s safety should be so ignored. It does not make any sense that allegations of brainwashing should keep me completely from my father, while allegations made by my sister herself of sexual abuse do not keep my sister from living with my mother when she did not even want to live there in the first place. If she feels more comfortable living with our father, she should be able to do that. He’s an amazing father. I only wish that more kids had a parent who makes them feel as special as my father makes us feel. And as for my father’s supposed knack for “brainwashing” me, – If the consistency of my perspective throughout this tumultuous ordeal does not prove it to be a perspective all my own, then I do not know what will. All I have to offer is the truth. Plain and simple. Courts, lawyers, state officials… they can all pick it apart and challenge it as much as they’d like, but when it comes down to it – the truth is one thing you cannot manipulate. Only people can be manipulated.
    Please, do not allow yourself to be manipulated into forfeiting freedom to corruption in the single governing body under which are all united. Do not let fear oppress liberty. I understand that many people who have been involved in dealing with my case have been victims, too. I would like to take the opportunity to make it clear that my goal is not to avenge them. My goal is to show them. The only proper thing to do now is to show the truth to those people who have been deceived, and to show what is right to those people who have done wrong. As Benjamin Franklin once pointed out, “There is no kind of dishonesty into which otherwise good people more easily and frequently fall than that of defrauding the government.” The evidence of this corruption is all there. I just need someone to help me get my voice heard and to encourage others involved to stand up to it.

  26. I am a conservative, but I totally agree with impeachment first of Cheney and then of Bush. Hurry up They should be tried for treason. No pensions for them. They are bad men. Cheney and probably the Bush family had personal interests for agrandizement with this war. The war with Iraq is a national disgrace. It was never worth one drop of American blood.
    When Clinton was impeached the whole thing was a sham. He should have been impeached on charges of treason. Let’s get going. Hurry up. Hurry up. Hurry up.
    There is no reason for us to police the whole world or to give free moneys to every country that asks supporting socialist governments everywhere so they can bite us.

  27. I would really love to tell you me story. I have two children who have been ripped from my home by NJ DYFS. My story begins in Newton NJ. On Jan 7Th 2006 my home was broke into, and I was assaulted. I at the time couldn’t remember what had happen. I woke up in the middle of my living room floor there was blood all over my face. The coffee table was laying on top of me. I believed my assaulter to be the ex mayors son. My ex and the Father of my children who also still lived in my home was dating this man ex girl friend and had passed threats of harm. Before my assault my car tires were sliced 3 different times. This man not only being the ex mayors son but also a drug addict a police informant and has a long criminal record. During the investigation the police found out that I was suffering from Post podium and that I was on a low dose of Lexipo to control it. They used this against my to cover for my assaulter saying my wounds were self in flicked. They also made a call to DYFS stating this. DYFS said that I had neglected my kids due to this. A caseworker would show up at are home once a week and they lied to me and my ex and told us that we would be going to this place to get coupled counseling to try to work out are problems and when we got there it was a eval. Don got up and left but I stayed and did it thinking it would look bad if I didn’t. After this they came up with a whole list of things that they claimed we need to do. I refused to do these things standing my ground that I was assaulted. A few months later I got a call from my sons day care telling me that they had got a call from some parents stating there children said that another 6 year old had touch my son on him prevent parts in the day care. They also said that they called DYFS about this matter. When the caseworker that looked into this showed up at are home she said that the girl that was said to have touched my son have not attended this day care for more then six months and they did not find the story to be true. She also said that this was no the day care and had nothing to do with us. After months of harassment from DYFS and the Newton police we moved from the county to warren county. During the move my son went on vacation to Disney world with his grandmother great grandmother aunt and cousin. This turned out to be a big problem for DYFS and the began calling and stopping by every other day. Drilling us about where Damon was and trying to get addresses in FL. We moved to Believed NJ but we told DYFS me and the kids moved to PA hoping they would leave us alone. But they continued to show up at our home in Believed all the time and they even showed up at my job. all the while trying to get us to do there services. After three months of this Don did something stupid and got arrested some how DYFS got wind of this however they said it was a drug charge but it wasn’t. On this note Sussex county DYFS took us to court in Warren county. This was done to force us to take there help. We were now court ordered to do the services. We do not drive nor have a car to get to all of the places they wanted us to go and they wouldn’t give us transport to get there so we didn’t go. In Jan of 2007 I applied to Bel-Rea school in Denver CO and got in. We when to CO in march to find a place to live there and rented a home. In the mean time after all this time Sussex county DYFS sent the case to Warren county. When the caseworker was assigned from warren she showed up at our home 2 days before we moved to CO. I told her I really didn’t trust DYFS and had nothing to say but she keep pushing for info. Seeing I was getting very upset Don asked her to leave 6or7 times before she did. She then went back to the office and wrote a false report saying that my dog attacked her and that Don slapped me in front of her. We have an eye witness that this is a lie and also taped the hole thing. 2 days later we moved to CO. With advice from my lawyer not telling anyone where we were. We were also not under any court order say in that we could not leave the state of NJ. Three weeks later we started getting calls on Dons cell from DYFS we never picked up the phone. Then Don’s mother started calling DYFS sent the police there looking for us and keep pushing her for info this went on for days. We never told her where we were going either on the 10Th of May 2007 a detective told DYFS where we were and gave then are address. The next day they when to court and told a judge that they didn’t know where we were but they believed us to still be in NJ. Also admitting the false report wrote by the case worker that came to our house. On that DYFS was giving a court order for custody of our kids. We were then threatened with criminal charges and a amber alert if we did not turn them over. DYFS picked then up in CO. Don and myself got on the next plain back to NJ. Only about 3 days later we were giving a visit with are kids my daughter who was only a year old showed up with a black eye a bruised nose and they couldn’t tell us for a week what happen and when they did the said my son did it to her. My son loves his sister very much and would never hurt her. The next visit my son showed up with marks on his neck that looked like he was choked. My daughter had a large bruise on her but that a DYFS tried to say was from her falling on a toy. She also had a bleeding rash for almost a month. Finally I got a call from our caseworker stating my daughter had fallen off a top bunk bed she was okay but had some burses. This was also blamed on my son. Then they moved them to a new foster home. In this foster home my son told us he was heating up water in a microwave to take a bath. When we questioned this they said my son was lien to get are attention. I saw something that was disturbing to me when I changed my daughters dyper and I call the abuse hot line about this. Also leaving a message for are caseworker who in turn called the foster mother and warned her investigators would be coming to her home. I was told that the investigators from DYFS didn’t think that she was being abused. When I asked if the inveagaters had an MD they said no. I told her I wanted my daughter checked by a doctor and I was told that the test would be to traumatizing to her. On that I called the child advocates and Wrote a email to the commissioner. One week later a doctors appointment was made for her. They have never given my attorney a report from that doctor that says what they stated as no abuse. For the last almost year Don and myself have been saying in NJ with friends and family and paying rent for our home in CO they have withheld evidence reports from service providers at 2 court dates. I got a letter from the area director after I told her I had a copy of the fax transaction stating they had the reports before our court date on the 27Th of Nov. They were sent the 17Th of NOV. They still said they did not get the reports on the 2ed of Jan at our next court date. The area director said they got the reports on Dec 27Th and it was a “oversight” that the court didn’t get them. Even after I told me caseworker that I got the letter from the area director she still says that she didn’t get then till after court on the 2ed of Jan. I have wrote letters to Kevin Ryan the child advocate and the child placement board. We went to a meeting on the 10Th of march were I have them on tape saying that we have never neglected or abused are kids we have done a great job advocating for them but they are seeking adaption because we blame them for not doing there jobs. Arguments Against Bush Impeachment...

• If we impeach Bush, we’ll get President Cheney!
The first impeachment resolution introduced by McKinney included Bush, Cheney, and Rice. Although, even if we only initially pursue Bush, initiating the impeachment process will lead to an investigation that will implicate lots of people in the Bush administration who are guilty of committing crimes, including Cheney.

No matter who we get to replace Bush, we’ll be showing those in power that anyone who breaks the law will be held accountable.

• Promoting impeachment will seem too “extreme.”
Demanding that crimes be investigated is NOT extreme. Some previous impeachment attempts were considered extreme because they were pursued for actions that didn't rise to the level of a Constitutional crisis, which is what the impeachment tool is meant to be used for. Nixon's impeachment, however, was bipartisan.

  • We should wait to impeach...
Wait to impeach? We've waited 3 or more years too long already. We had enough evidence to impeach years ago. Remember, an impeachment only means you have enough evidence to warrant a trial, just like an indictment. Our congress people didn't take an oath to bipartisanship. They took an oath to the Constitution. Besides which, our troops, Iraqi civilians, and our own civil liberties are all waiting for this.
 
• Before we impeach, we should get some legislation passed...
And with unconstitutional Presidential Signing Statements, veto power, and the power of "Commander in Chief" at his disposal, how do you think Congress is going to get anything accomplished without first impeaching Bush?

If your tire blows while you're driving, do you stop to fix it? Or do you continue driving on your rim because to stop would take too much time?

• It hurts the democracy to go through a presidential impeachment. And Bush is a lame duck anyway.
Holding government officials accountable for their actions strengthens our democracy. Letting lawlessness stand weakens it.

Sometimes reprimanding a child (president) doesn't make the family (Washington) a happy place. But you still have to do it so the child and his siblings (future presidents) learn about accountability. Impeachment is horribly UNDERUSED, which is part of why there's so much corruption at the top. Politicians must learn to fear it. People think things are better because we improved the make-up of our law-making body, Congress. But Bush is BREAKING LAWS. So, it doesn't matter how many laws Congress passes if they don't serve their OVERSIGHT duties as well by impeaching. They swore to defend the Constitution. What are laws without enforcement?

Besides, considering Bush's track-record of breaking laws, he can still do a lot of damage. Our troops, Iran, and our Supreme Court are all endangered so long as he remains in office. Waiting until Bush is out of office will leave us complicit in any further crimes he commits. The Union of Concerned Scientists has estimated that the death toll from a "tactical" nuclear weapon of the kind Bush is contemplating using in Iran would be at minimum 3 million men, women, and children. The path of death would stretch across country boundaries into India.

Perhaps worst of all, we set a terrible precedent by allowing Bush to stay in office after he's broken so many laws. Impeachment will stop future presidents from using Bush's actions as justification for even more lawbreaking and erosion of civil liberties.

• I'm a Democrat/
Republican. If we support impeachment it will lower the chances of my party winning in 2008.

So, your party would rather win elections than do what's right for the country? I hope you're wrong. I also hope the public is willing to throw additional support to any party that holds our elected officials accountable for their actions. This has been historically true with every single impeachment effort launched. And this impeachment effort would begin with majority support (unlike most past impeachments including Nixon).

• Impeachment will never happen. Congress members will block it.
Well, all we need is a majority of support in the House. And 2/3rds vote in the Senate to remove Bush from office will happen once the evidence gets aired on the floor of the House, and subsequently the national media outlets. The political pressure will become too great.

Today's impossibility is tomorrow's reality. Congress members will realize that tying their political future to Bush reduces their chances of getting elected. Remember, one way or another, Bush is gone by 2009— but members of Congress may retain their offices beyond that date. Bush's poll numbers are extremely low, and most Americans support impeachment. This is a bipartisan movement. This means that if we make the pressure unbearable for Members of Congress, they'll turn on him to keep their own seats (like they did with Nixon). It's already starting to happen. While many Members of Congress have behaved unethically in the last few years, it's important to understand that this is related to their warped view of what's in their self-interest. Let's wake them up to their true self-interest (impeaching the president), by showing them our support for impeachment.

And even if we only impeach, and the Senate fails to do their duty and remove him from office, it will only implicate the Senators who fail to do their sworn Constitutional duty.

• But Speaker of the House Pelosi said that Impeachment was "off the table."

Pelosi most likely said this to remove any appearance of conflict-of-interest that would arise if she were thrust into the presidency as a result of the coming impeachment. What we need to do is to pressure Pelosi not to interfere with impeachment maneuverings within her party. Sending her Do-It-Yourself impeachments legitimizes her when she joins the impeachment movement in the future.
